Terms & Conditions

Acupuncture by Kim is required to act in accordance with legal regulations. The rights and obligations of the client and the care provider are recorded, among other things, in the Medical Treatment Contracts Act (WGBO) and the Quality, Complaints, and Disputes Act in Healthcare (Wkkgz).

Acupuncture by Kim keeps an electronic patient record containing personal data, anamnesis data, and treatment reports. The client has the right to inspect their own file. The file is kept for 20 years in accordance with the legal retention period.

According to the General Data Protection Regulation (GDPR), Acupuncture by Kim is obliged to protect your privacy, which is why we work with a declaration of consent for data processing.

Acupuncture by Kim also works with a treatment agreement, which contains agreements that we aim to achieve together for a good treatment.

By making an appointment and undergoing treatment, you agree to both the declaration of consent for data processing and the treatment agreement. Acupuncture by Kim reserves the right to terminate the treatment.

You must inform us during the intake conversation and before the treatment of any medication use, pregnancy, or treatment by a doctor, therapist, specialist, or other practitioner. It may be necessary to make adjustments to the treatment based on this information.

If you are already under the care of a doctor, therapist, specialist, or other practitioner, we may ask you to consult with them to find out if our treatment can be applied during the current treatment period.

Acupuncture by Kim is not responsible for damage and/or injury resulting from the concealment of medical information such as physical and/or mental conditions, pregnancy, injuries, and medication use.

Payments are made directly after the treatment, in cash or by debit card. You will receive the receipt or invoice by email after payment.

As a service, you will receive a reminder of your appointment via email. If the email cannot be sent or is not received for any reason, you are responsible for fulfilling the appointment and being present on time. Due to subsequent clients, the time you arrive late will be deducted from your treatment time.

Acupuncture by Kim is not responsible for damage, loss, or theft of personal belongings.

Complaints procedure

If you are dissatisfied with any aspect of our services, and we cannot resolve the issue together, you can seek support or submit a complaint to the professional association Zhong, of which we are a member. A complaints officer from Zhong is independent and can advise you on finding a solution. All information is confidential. You can also submit your complaint as a dispute to the Healthcare Disputes Foundation (SZG).

Under the General Data Protection Regulation (GDPR) as of May 25, 2018, Acupuncture by Kim is required to inform its clients of what data is being recorded and who has access to this data.

For a complete treatment, a medical record is necessary. This is also a legal obligation imposed by the Medical Treatment Contracts Act (WGBO). Your medical record contains notes about your health condition, underlying patterns, and data on the performed examinations and treatments. The data is recorded, carefully stored, and kept for 20 years as prescribed by the WGBO. We ensure your privacy and professional secrecy.

As your treating therapist, Acupuncture by Kim is the only one who has access to the data in your medical record and has a legal duty of confidentiality (professional secrecy). The following data will be recorded:

General data:
  • Name, address, postal code, place of residence
  • Date of birth
  • Gender
  • Phone number
  • Email address
  • General practitioner
  • Citizen Service Number (BSN)
Anamnesis data:

To get the most complete picture possible of your situation, we take an anamnesis during the intake interview. The following data will then be requested, recorded, and kept:

  • Your main complaint and additional complaints
  • Chronic conditions / Surgeries / Accidents / Medical conditions from the past / Possible pregnancies / Childbirths
  • Life events / Traumas
  • Medication / Supplements / Drugs
  • Family / Home situation / Work / Sports / Hobby
  • Various questions on which a TCM therapist can form a complete picture and make a correct diagnosis
Access and sharing of data

At the client’s request, the therapist will grant access to the medical record, and a copy will be provided if requested. The client has the right to have their data removed/destroyed. This must be requested in writing.

Only upon request and in consultation with the client concerned, their data will be shared. Written permission from the relevant client is required for this. Only when legally necessary, your data may be provided to third parties without your consent.

The medical record contains data that is necessary for your treatment and that the therapist, with your explicit permission, can obtain from another healthcare provider; for example, your general practitioner or a specialist.
